AS11000 – Training
Australian Standards will soon be issuing a new form of contract, AS11000, along with a suite of companion documents including subcontracts, explanatory notes and the like. Originally planned for release in November 2016, a further draft copy is expected to be issued for comment in October, possibly pushing back the publication date to early 2017.
The new form of contract, which supersedes and replaces the well worn AS2124:1992 and AS4000:1997 forms, will have important implications for users, not least the owners, principals and contractors.
Taking its cue from other, progressive, standard forms of contract used internationally, it uses clearer and more dynamic language with, it is argued, better management and allocation of risk.
Some of the changes and new provisions include:
- Obligations of good faith, cooperation and honesty
- Early warning of risk
- Greater programming obligations
- An overhaul of extension of time provisions and associated delay damages and delay costs
- The introduction of a prospective variation notification process and an associated time bar
- A requirement to use the AS11002 form of subcontract for subcontractors over a certain value
- A detailed procedure in regard to rectification of defects
- Incorporation of the relevant State or Territory’s Security of Payment legislation
- Expanded dispute resolution process
- A reduction in the contractual interest rate for late payments
The above, and other changes, represent a significant departure from the more traditional contracts it replaces and there will be a steep learning curve for early adopters.
For that reason we shall be running full day seminars on the new form of contract as early as December 2016 (if AS11000 is published in November) in capital cities throughout Australia and other locations as necessary.
We are delighted to announce that our seminars have been full endorsed by the Chartered Institute of Building, we are the only training provider in Australia on AS11000 to have received this endorsement.
The cost for a full day’s training will be $599 plus GST per person. CIOB members receive a $50 discount. We can also offer discounts for bulk bookings.
Currently seminars are planned for Brisbane, Sydney, Perth, Melbourne and Adelaide. Further locations will be added soon.
